If you are about to list your home for sale, or you are going to start looking to purchase a new home, when you start talking to Realtors, it is important you know your rights related to services provided by the Realtor. You will find at the bottom of my Home Page a button that will take you to my two required forms. You will also find them on the Texas Real Estate Commission (TREC) website. You will also find on the (TREC) website if the broker or agent has had some form of disciplinary action taken against them by the commission.
Texas law requires all brokers and sales agents to provide written notice regarding information about brokerage services at the first substantive communication with prospective buyers, tenants, sellers, and landlords concerning specific real property. The Information About Brokerage Services form (or the IABS) is the required method to provide that information to those parties.
It is important to remember that the IABS must both be delivered at the first substantive communication, and the completed IABS must be posted on the homepage of the license holders’ business website. A business website is a website controlled by the license holder, accessible to the public, and that contains information about a license holder’s real estate brokerage services.
A BROKER’S MINIMUM DUTIES REQUIRED BY LAW (A client is the person or party that the broker represents): 1) Put the interests of the client above all others, including the broker’s own interests;2) Inform the client of any material information about the property or transaction received by the broker; 3) Answer the client’s questions and present any offer to or counter-offer from the client; and 4)Treat all parties to a real estate transaction honestly and fairly.
